We are TCS Nederland BV and are active as a recruitment agency in various sectors. The party with whom you register or contact in the context of our services qualifies as the controller within the meaning of the General Data Protection Regulation (“GDPR”) for the processing of your personal data in that context. This privacy statement applies to the processing of personal data that we, TCS Nederland BV process from you, as a user of our services or as a website visitor. In the following we will be referred to as “TCS Nederland BV” for convenience.

Who we are

TCS Nederland BV is located at Eusebiusbuitensingel 32-1, 6828 HW in Arnhem. TCS Nederland BV is the controller within the meaning of the GDPR and therefore has control over the processing of personal data and determines the purpose and means for the processing.

TCS Nederland BV sometimes engages other companies to perform services for it. TCS Nederland BV remains responsible for the processing of your personal data in these situations. TCS Nederland BV makes contractual agreements with these companies about the handling of your personal data, so that your privacy is guaranteed.

Technical Information

When you visit our website, the website automatically collects information about the (devices of) our visitors. These concerns, for example, information with which device the website is visited, the IP address of your device, the IP address of your Internet Service Provider, the operating system you use, the date and time of your visit, the internet address of the website. from which you linked directly, the pages you visited and the information you viewed on the website, the geo location where you are located and the material you upload to and download from the website. When do we collect your personal data?

We are permitted to store and process your data in the following cases:

Why do we collect your personal data

Your personal data is used to provide the HR services offered to you as well as possible, including temporary employment, secondment, mediation, payroll, salary administration, personnel management, personal development & employability and recruitment & selection.

TCS Nederland B.V. uses your data for the following purposes:

  • Matching supply and demand on the labor market.
  • To inform you of interesting offers of products and services from TCS Nederland B.V. and from third parties.
  • Register hours worked and process them in our payroll system.
  • To be able to assess your suitability and availability in connection with a mediation for permanent or temporary work or an assignment, whereby test results can also be used.
  • To approach you for commercial offers, newsletters and promotional campaigns that may be of interest to you, only if you have registered for this ( opt -in).
  • To enter into and maintain an employee or personnel/intermediary relationship with you and to carry out the relevant administration for this purpose.
  • To fulfill our reintegration obligations and to comply with (the objective imposed by the government) to help people with a large(er) distance to the labor market find work.
  • To be able to record an assignment with the client in an agreement with the client and to maintain and comply with the agreement with the client.
  • To process data for the benefit of our clients in the context of a pre-employment screening.
  • To promote your personal development and employability, including training, education and testing.
  • For management purposes, including management information, providing internal controls and company safety and conducting audits and audits.
  • Quality purposes such as certification.
  • Apply for subsidies, premium discounts, etc.
  • If we have entered into an employee or personnel/intermediary relationship with you, for compliance with laws and regulations, including but not limited to identification, employment legislation, tax and social security legislation, combating fraud and national and international sanctions legislation.

What personal data do we collect from you?

TCS Nederland B.V. can, if you are a job seeker, candidate, seconded, (temporary) employee, self-employed person and/or business relation of TCS Nederland B.V., process the following personal data. You are responsible for ensuring that the personal information you provide is correct and up to date.

Job seeker or candidate
  • Name and address details, e-mail address, telephone number and other contact details
  • Birth details, age, gender
  • Curriculum vitae (CV), information about education, internships and work experience
  • Information about training and education and/or tests that you have followed or done yourself or through us
  • Information about availability and leave
  • Other information that is (or may be) important in the context of assessing the suitability of the candidate, for example references and testimonials and information regarding work experience
  • On a voluntary basis other content with which you introduce yourself (video, photo)

Other than the data mentioned above, the processing of which is required pursuant to or necessary for the purposes of the application of the law

Seconded, (temporary) employee and self-employed person
  • can work/work/have worked for TCS Nederland BV or its clients, TCS Nederland B.V. can process the following data:
  • Name and address details, e-mail address, telephone number, bank and/or giro account number and other contact details
  • Birth details, age, gender
  • Curriculum vitae (CV), information about education, internships and work experience
  • Information about training and education and/or tests that you have followed or done yourself or through us
  • Information about availability and leave
  • Nationality, citizen service number & proof of identity (copy of proof of identity), any work permit
  • Data in the context of a pre- employment screening
  • Data concerning the nature and content of previous job placements, as well as their termination
  • Other information that is (or may be) important in the context of assessing the suitability of the candidate, for example references and testimonials and information regarding work experience
  • Other data related to the personnel, salary and absence registration
  • On a voluntary basis other content with which you introduce yourself (video, photo)
  • Other than the data mentioned above, the processing of which is required pursuant to or necessary for the purposes of the application of the law

Third parties

TCS Nederland B.V. can pass on your personal data to other entities of TCS Nederland B.V., its clients, subcontractors (for example data processors) who provide services or carry out assignments on behalf of TCS Nederland B.V., suppliers, government agencies and other business relations. And in all other cases where we can be obliged to do so, for example by a court order or a court judgment.

The provision of personal data takes place on the basis of a legitimate interest, legal obligation and/or for the implementation of the agreement in accordance with the goals stated under “Why do we collect your personal data?”.

Your personal data may be transferred outside the Netherlands. TCS Nederland B.V. has taken the necessary measures to ensure that the personal data transferred is adequately protected.

Data transfer to countries outside the EU

We use the services of Manatal, an Applicant Tracking System (ATS) based in Thailand (outside the EU). As Thailand does not provide an adequate level of protection according to the European Commission, we take the necessary steps to ensure that the personal data of candidates transferred to Manatal is adequately protected.

The data transfer to Manatal is carried out based on Standard Contractual Clauses (SCCs) approved by the European Commission. These clauses require Manatal to process personal data in accordance with the GDPR and to implement appropriate technical and organizational security measures. For more information about how Manatal processes personal data, we refer to the privacy statement of Manatal.

Your Rights

View and/or change data

You can request us at any time via administratie@tcsnederland.nl or by letter to Eusebiusbuitensingel 32-1, 6828HW in Arnhem to indicate which (categories of) data we process from you, for what purposes. from which source the data comes and which retention periods are used by us.

In addition, you can contact us at any time to supplement, correct or delete your data. In the unlikely event that we have provided incorrect personal data about you, we will rectify this.

When we have changed your personal information, we will notify you.

Restrict processing of your data

If you do not agree with the content of the data we store about you, you can submit a request to temporarily limit the processing of your data. We will then wait with the distribution of your data until, in your opinion, it is in order again. When we restrict processing of your personal data, we will notify you.

Right to transfer data

You can also withdraw any consent you have given to process your data at any time. We will cease processing your personal data for which you have given permission. However, withdrawing your consent will not affect the processing that has already taken place.

Procedure, response time and costs

We try to handle your requests as mentioned in this chapter as soon as possible, but at the latest within [one month]. We are required to verify your identity before fulfilling your requests. In principle, your requests will be handled electronically, unless this is not possible or you request otherwise.

In principle, we do not charge you any costs for handling your aforementioned requests, unless your requests are excessive, manifestly unfounded or if you request additional copies under the right of access.

Data storage and security

We take appropriate technical and organizational measures to protect personal data from loss or unlawful processing. Data is stored within the EU, unless stated otherwise, such as in the transfer to Manatal in Thailand, which is carried out with the necessary protective measures.

TCS Nederland B.V. makes every effort to optimally protect your personal data against unauthorized use. We do this by means of physical, administrative, organizational and technical measures. For example: only authorized persons have access to the data. If and insofar as data is provided to data processors who provide services or carry out assignments on its behalf, TCS Nederland B.V. has agreed with them that they will also optimally protect the personal data. 

Retention period

We do not retain personal data longer than necessary for the purposes for which it was collected. Candidate data is retained for up to 18 months after the last interaction, unless a longer retention period is legally required.

Questions, comments, complaints or (suspected) data breach

Algemeen uitgangspunt

De
bedrijfsvoering van TCS Nederland B.V. is er op gericht om werkzoekenden een
eerlijke kans op werk te geven, ongeacht diens leeftijd,
geslacht, burgerlijke staat, seksuele gerichtheid, levens-, politieke of geloofsovertuiging,
ras, etnische afkomst of nationaliteit
.

Bij de werving
en selectie worden werkzoekenden gelijk behandeld doordat zij uitsluitend worden
beoordeeld op criteria die functie-gerelateerd zijn.

Doel

 

Het doel van dit beleid is om jegens de
medewerkers en derden duidelijk en transparant te zijn over:

1.   
Wat
TCS Nederland B.V. verstaat onder discriminatie
/ discriminerende
verzoeken;

  1. Wat
    het standpunt is van
    TCS
    Nederland B.V.
    ten opzichte van discriminatie/

werkzaamheden (ter ondersteuning van de bedrijfsactiviteiten) rondom de werving
en selectie;

b. Waar de medewerker terecht kan voor overleg en/ of een
melding;

  1. Verantwoordelijkheden
    van de werkgever.

 

1.    Definitie
discriminatie

Onder
discriminatie wordt verstaan: het maken van direct en indirect onderscheid
tussen personen op grond van leeftijd, geslacht, burgerlijke staat, seksuele
gerichtheid, levens-, politieke of geloofsovertuiging, ras, etnische afkomst of
nationaliteit.

Onder
discriminatie wordt uitdrukkelijk ook verstaan het ingaan op verzoeken van
opdrachtgevers om bij de werving en selectie onderscheid tussen personen te
maken op basis van criteria die niet noodzakelijk of relevant zijn voor een
goede invulling van de functie.

2.    Standpunt
van TCS Nederland B.V.

a.   
TCS
Nederland B.V. wijst iedere vorm van discriminatie af.

b.   
Verzoeken
van opdrachtgevers om bij de werving en selectie rekening te houden met
bepaalde criteria worden uitsluitend gehonoreerd indien er sprake is van objectieve rechtvaardiging.

Er
is sprake van objectieve rechtvaardiging als het selecteren op de verzochte
criteria:

·        
Een
legitiem doel dient. Dit houdt in dat
er een goede -functie gerelateerde- reden is om bij de werving en selectie te
selecteren op betreffende criteria (een voorbeeld van een legitiem doel is
veiligheid);

·        
Resulteert
in het bereiken van het legitieme doel, het
middel is geschikt om het doel te bereiken;

·        
In
redelijke verhouding staat tot het doel, er
is sprake van
proportionaliteit ten
opzichte van het doel
;

·        
Noodzakelijk
is omdat er geen andere, minder onderscheid makende manier is om het doel te
bereiken, er wordt voldaan aan het noodzakelijkheidscriterium.

c.    
TCS
Nederland B.V. tolereert niet dat de medewerkers discriminerend worden bejegend
door derden. Onder medewerkers wordt hier tevens verstaan de werknemers die
werkzaamheden verrichten onder leiding en toezicht van een inlener.

3.    Handelen
door de medewerkers

a.   
De
medewerkers hebben een eigen verantwoordelijkheid om alert te zijn op verzoeken
van opdrachtgevers met een discriminatoir karakter, dergelijke verzoeken te
herkennen en er zorg voor te dragen dat er geen medewerking aan wordt verleend.

b.   
Indien de medewerker twijfelt over
het al dan niet aanwezig zijn van een objectieve rechtvaardiging bij een v
erzoek van een opdrachtgever om bij de
werving en selectie rekening te houden met bepaalde criteria,
of
vragen heeft hoe een verzoek af te handelen, kan de medewerker voor overleg terecht
bij de afdeling recruitment

c.    
Indien de medewerker discriminatie
signaleert en het aan de orde wil stellen, 
m
isstanden of
wangedrag wil melden
en/ of een vertrouwenskwestie aan de hand heeft, kan de medewerker
terecht bij de
afdeling recruitment
Indien dit niet leidt tot een voor de medewerker afdoende resultaat kan de
medewerker terecht bij
de directie van TCS Nederland B.V..

4.    Verantwoordelijkheden
van werkgever

TCS
Nederland B.V. is verantwoordelijk voor:

a.   
Het
creëren van een veilig werkklimaat waar men elkaar met respect bejegent, er ruimte
is voor constructief overleg en ongewenst gedrag in welke vorm dan ook
voorkomen en aangepakt wordt;

b.   
De
kenbaarheid en implementatie van onderhavig antidiscriminatiebeleid. Hieronder
wordt onder meer verstaan het er voor zorgdragen dat de medewerkers:

·        
geïnformeerd
zijn over en vertrouwd zijn met het beleid. Dit document wordt openbaar
gepubliceerd op onze website en is inzichtelijk in het medewerkers portaal.

·        
goede
instructies hebben gekregen hoe discriminatie en discriminerende verzoeken te
herkennen.

·        
voorbereid
zijn op de situatie dat zij worden geconfronteerd met een discriminatoir
verzoek en weten op welke manier zij het gesprek met opdrachtgevers kunnen
voeren en keren. Dit wordt gerealiseerd door hier openlijk met alle medewerkers
het gesprek over aan te gaan.
 

c.    
De
evaluatie en bijstelling van onderhavig beleid.

Anti-Discrimination Policy in Recruitment and
Selection

General Principle
The operations of TCS Nederland B.V. are aimed at providing job seekers with a
fair chance at employment, regardless of age, gender, marital status, sexual
orientation, beliefs (life, political, or religious), race, ethnic origin, or
nationality. During recruitment and selection, job seekers are treated equally
and assessed solely on job-related criteria.

Objective

The objective of this policy is to be clear and
transparent to employees and third parties regarding:

  1. What
    TCS Nederland B.V. considers discrimination/discriminatory requests;
  2. The
    position of TCS Nederland B.V. regarding discrimination/discriminatory
    requests;
  3. Actions expected from employees:
    • How
      employees are expected to act during their duties, especially in
      recruitment and selection tasks that support business operations;
    • Where
      employees can go for consultation and/or to report issues;
  4. The employer’s responsibilities.

1. Definition of Discrimination
Discrimination is defined as making direct or indirect distinctions between
people based on age, gender, marital status, sexual orientation, beliefs (life,
political, or religious), race, ethnic origin, or nationality. Discrimination
also explicitly includes complying with client requests to make distinctions in
recruitment and selection based on criteria that are neither necessary nor
relevant for adequately fulfilling the role.

2. Position of TCS Nederland B.V.

a. TCS Nederland B.V. rejects all forms of
discrimination.

b. Requests from clients to consider specific criteria
during recruitment and selection are only honored if there is an objective
justification.

There is an objective justification when selection
based on the requested criteria:

  • Serves
    a legitimate purpose. This means there is a valid, job-related reason to
    select based on the requested criteria (an example of a legitimate purpose
    is safety);
  • Results
    in achieving the legitimate purpose, meaning the method is suitable to
    reach the goal;
  • Is
    proportionate to the purpose, meaning it is reasonably balanced with the
    goal;
  • Is
    necessary because there is no other, less discriminatory way to achieve
    the purpose, meeting the necessity criterion.

c. TCS Nederland B.V. does not tolerate discriminatory
treatment of employees by third parties. Here, “employees” also
includes those performing tasks under the direction and supervision of a hirer.


3. Actions by Employees

a. Employees have a personal responsibility to be
alert to client requests with a discriminatory nature, to recognize such
requests, and to ensure that no cooperation is provided.

b. If employees are uncertain about the presence of
objective justification in a client’s request to consider specific criteria
during recruitment and selection, or if they have questions about handling a
request, they can consult the recruitment department.

c. If employees identify discrimination, wish to
address it, report misconduct or inappropriate behavior, or have a
confidentiality issue, they can consult the recruitment department. If this
does not provide a satisfactory outcome, employees can turn to the management
of TCS Nederland B.V.


4. Employer Responsibilities

TCS Nederland B.V. is responsible for: a. Creating a
safe work environment where respect is shown to each other, there is room for
constructive consultation, and unwanted behavior in any form is prevented and
addressed;

b. Publicizing and implementing this
anti-discrimination policy, which includes ensuring that employees:

  • Are
    informed about and familiar with the policy. This document is publicly
    available on our website and accessible via the employee portal;
  • Have
    received clear instructions on recognizing discrimination and
    discriminatory requests;
  • Are
    prepared for situations where they might face discriminatory requests and
    know how to handle discussions with clients. This is achieved by openly
    discussing these matters with all employees.

c. Evaluating and adjusting this policy as needed.
